These Terms and Conditions cum Privacy Policy govern access to and use of the Fiatano website, platform, payment links, order forms, communication channels, customer support channels, transaction workflows, and all related services made available under the name Fiatano. By accessing the website, placing an order, submitting KYC information, making payment, receiving payment, transferring or receiving any Virtual Digital Asset, or communicating with Fiatano in relation to any transaction, you agree to be bound by this document. This document is intended to operate both as the contractual terms applicable to Fiatano services and as the privacy notice explaining how Fiatano may collect, use, retain, process, disclose, and protect personal information and transaction information.
1. Acceptance of Terms
By using Fiatano, you confirm that you have read, understood, and accepted this Terms and Conditions cum Privacy Policy. If you do not agree with any provision, you must not access, use, or attempt to use Fiatano services.
Fiatano may decline, suspend, restrict, or terminate access to services if a user fails to comply with this document or if Fiatano determines that the transaction or user profile creates legal, regulatory, financial, cybercrime, tax, or reputational risk.
2. Definitions
- Fiatano means the brand, website, platform, systems, workflows, payment links, communication channels, and related services operating under the name Fiatano.
- User, you, your, or customer means any person, business, entity, representative, agent, or authorised user accessing or using Fiatano services.
- Virtual Digital Asset or VDA includes cryptocurrency, crypto asset, stablecoin, token, or any other asset treated as a virtual digital asset under applicable law.
- Transaction means any purchase, sale, transfer, receipt, payment, payout, deposit, withdrawal, conversion, settlement, exchange, order, or attempted dealing involving fiat currency and/or VDAs through Fiatano.
- KYC means know-your-customer verification, including identity verification, PAN verification, bank verification, address verification, source of funds checks, wallet checks, and any additional due diligence required by Fiatano.
- Personal Data means any information relating to an identified or identifiable person, including identity information, contact information, financial information, KYC records, tax information, device information, and transaction information.
- Third-Party Payment means any payment made from, or payout requested to, a bank account, UPI ID, wallet, payment instrument, or account not owned and controlled by the verified user.
3. Nature of Fiatano Services
Fiatano provides technology-enabled digital asset access, settlement, payment, customer support, compliance, liquidity, and related facilitation services. Fiatano services may include buying, selling, settlement, on-ramp, off-ramp, OTC-style support, payment verification, payout support, transaction reconciliation, and customer communication concerning VDAs and fiat currency.
Fiatano may provide services directly, through internal liquidity, through payment gateways, through banking channels, through technology service providers, or through other lawful operational arrangements.
Fiatano does not represent that any VDA is legal tender, government-backed currency, deposit, security, investment product, guaranteed instrument, or risk-free asset.
4. Eligibility
- You must be at least 18 years of age and legally competent to enter into a binding contract.
- You must use Fiatano only for lawful purposes and in compliance with all applicable laws.
- You must not be a sanctioned person, politically prohibited person, restricted person, or a person acting on behalf of any sanctioned, prohibited, or restricted person or jurisdiction.
- You must use your own identity, your own funds, your own bank account, your own UPI ID, and your own VDA wallet unless Fiatano has expressly approved otherwise in writing.
- You must complete KYC, AML, tax, and transaction verification requirements whenever requested by Fiatano.
5. KYC, AML, CFT, and Transaction Monitoring
Fiatano may conduct KYC, anti-money laundering, counter-terrorist financing, sanctions screening, fraud prevention, cybercrime risk checks, wallet screening, transaction monitoring, and enhanced due diligence. These checks may be performed before, during, or after a transaction.
Fiatano may request identity documents, PAN, Aadhaar or other officially valid documents, bank statement, source of funds proof, source of wealth proof, address proof, wallet ownership proof, selfie, video verification, transaction purpose, invoice, declaration, or any other document reasonably required for risk assessment or compliance.
- Fiatano may pause, reject, cancel, reverse where possible, hold for review, or report any transaction that appears suspicious, inconsistent, high-risk, fraudulent, unlawful, or connected with cybercrime, scams, mule accounts, sanctions, or prohibited activity.
- Fiatano may retain KYC records, transaction records, risk records, communication records, payment records, IP logs, wallet records, and related evidence for legal, regulatory, tax, audit, fraud prevention, and dispute resolution purposes.
6. No Third-Party Payments
Fiatano strictly prohibits third-party payments. You must not make payment from another person's bank account, UPI ID, payment instrument, wallet, or account. You must not request payout to any account that does not belong to you. You must not use Fiatano to route, disguise, layer, split, or obscure funds.
- If third-party payment is detected, Fiatano may reject the transaction, hold the transaction, ask for additional documents, refund only to the original source where legally and operationally possible, suspend the user, report the matter to the concerned bank, payment gateway, regulator, law enforcement agency, or other authority, or take legal action.
7. Transaction Process and Finality
A Fiatano transaction may involve order placement, rate quotation, KYC verification, payment verification, VDA wallet verification, compliance review, settlement, VDA release, fiat payout, and reconciliation. Fiatano is not obligated to process or complete any transaction unless all verification, risk, payment, and compliance checks are completed to Fiatano's satisfaction.
A transaction is treated as complete only when Fiatano confirms completion or when the relevant VDA or fiat settlement is actually processed through the applicable banking, payment, or blockchain system. User screenshots, UTR numbers, transaction references, or bank messages do not by themselves constitute final confirmation of receipt or settlement.
8. Rates, Fees, Spreads, and Market Movement
Rates displayed or quoted by Fiatano may include market price, spread, liquidity cost, risk premium, platform fee, payment gateway fee, banking charges, blockchain network fee, tax deduction, or other applicable costs. Unless expressly confirmed in writing by Fiatano, rates are indicative and may be changed due to market volatility, liquidity conditions, payment delay, blockchain delay, technical error, or compliance review.
Fiatano may revise, cancel, requote, or refuse any order where payment is delayed, incorrect amount is paid, VDA confirmation is delayed, KYC is incomplete, third-party payment is detected, market price changes materially, or any risk or compliance concern arises.
9. Tax Compliance and TDS
Transactions involving VDAs may attract tax deduction at source, income tax, goods and services tax, reporting obligations, or other tax consequences under applicable law. Where applicable, TDS may apply on transfer of VDAs under Section 194S of the Income-tax Act, 1961, or any successor, amendment, clarification, or replacement provision.
You are solely responsible for determining your tax liability, maintaining records, filing income tax returns, claiming TDS credit where applicable, and consulting a qualified tax professional. Fiatano does not provide tax, legal, investment, or financial advice.
10. Wallet Address, Blockchain Network, and User Error
You are solely responsible for entering the correct wallet address, blockchain network, memo, tag, destination tag, chain type, QR code, and related details. Fiatano is not responsible for loss caused by incorrect address, wrong network, missing memo or tag, incompatible wallet, smart contract issue, blockchain congestion, network fee fluctuation, exchange restriction, or user error.
Once a VDA transfer is broadcast to a blockchain network, it may be irreversible and cannot generally be cancelled, reversed, modified, or recovered.
11. Payment Verification, Holds, Liens, and Disputes
Fiatano may treat payment as received only after the amount is actually credited and visible in Fiatano's bank account, merchant account, payment gateway dashboard, or settlement records. Fiatano may delay or refuse a transaction if payment is pending, reversed, disputed, made from an unverified account, linked with a lien, connected with a cybercrime complaint, or marked suspicious by a bank, payment gateway, or authority.
You must not initiate false disputes, false chargebacks, false cybercrime complaints, or false bank complaints after receiving VDA, fiat settlement, or service from Fiatano. If any payment is reversed, frozen, marked fraudulent, disputed, or subjected to a lien, Fiatano may suspend services, recover equivalent value, withhold pending settlements, share evidence, and initiate civil, criminal, cybercrime, recovery, or other legal proceedings.
12. Refund and Cancellation Policy
Due to the nature of VDA transactions, orders may not be cancellable once payment is received, VDA is released, VDA transfer is broadcast, fiat payout is initiated, rate is locked, or settlement has commenced. Fiatano may allow cancellation or refund only at its sole discretion.
Where approved, refunds may be made only to the original source account after deduction of applicable charges, payment gateway fees, banking charges, network fees, taxes, administrative costs, and losses arising from market rate movement. Refunds may be delayed or denied where third-party payment, cybercrime complaint, lien, suspicious source, incomplete KYC, or legal restriction is involved.
13. Prohibited Use
- You must not use Fiatano for money laundering, terror financing, sanctions evasion, fraud, scams, phishing, hacking, ransomware, illegal betting, gambling, darknet activity, drug trafficking, human trafficking, arms trade, fake investment schemes, Ponzi schemes, mule account activity, layering of funds, tax evasion, cybercrime, or any activity prohibited by law.
- Fiatano may investigate, pause, reject, report, or permanently block any user or transaction suspected to be connected with prohibited activity.
14. User Representations and Undertakings
- You represent that you are using your own true identity and lawful funds.
- You represent that all VDA transferred by you is lawfully owned and controlled by you.
- You agree not to submit forged, edited, false, misleading, incomplete, or manipulated documents.
- You agree not to misuse Fiatano, abuse support channels, manipulate systems, bypass compliance checks, or create artificial disputes.
- You understand that VDA transactions involve risk and may be irreversible.
15. Risk Disclosure
You understand that VDAs involve significant risks, including price volatility, liquidity risk, regulatory uncertainty, tax consequences, blockchain irreversibility, network congestion, wallet compromise, smart contract failure, stablecoin depegging, exchange failure, bank restriction, fraud risk, cybercrime risk, and possible total loss of value.
Fiatano does not guarantee profit, price, liquidity, availability, future value, legality in every jurisdiction, tax treatment, or uninterrupted services.
16. No Investment, Financial, Legal, or Tax Advice
Any information provided by Fiatano through the website, chat, email, phone, support message, advertisement, invoice, order page, or transaction communication is for operational and informational purposes only. Fiatano does not provide investment advice, portfolio management, financial advice, legal advice, or tax advice. You must make your own independent decision and consult qualified advisors wherever necessary.
17. Service Availability and Suspension
Fiatano may suspend, modify, restrict, or discontinue services at any time due to market volatility, liquidity shortage, banking issue, payment gateway issue, blockchain congestion, technical maintenance, security concern, compliance review, legal requirement, regulatory uncertainty, or force majeure event. Fiatano shall not be liable for losses arising from service interruption, transaction delay, rejection, suspension, or unavailability.
18. Privacy Policy — Personal Data Collected
Fiatano may collect personal, financial, technical, communication, and transaction-related information necessary to provide services, verify users, comply with law, prevent fraud, resolve disputes, and maintain security.
- Identity information such as name, date of birth, photograph, selfie, signature, PAN, Aadhaar details where applicable, passport, driving licence, voter ID, or other identification details.
- Contact information such as mobile number, email address, address, communication handle, and support history.
- Financial information such as bank account details, UPI ID, payment references, UTR numbers, statements, settlement information, invoices, source of funds records, and tax information.
- VDA transaction information such as wallet address, blockchain network, transaction hash, order amount, VDA quantity, rate, spread, network fee, settlement status, and wallet risk indicators.
- Technical information such as IP address, device information, browser information, operating system, approximate location, timestamps, cookies, logs, session details, and security metadata.
- Communication information such as emails, support tickets, WhatsApp or chat messages, call records where legally permitted, declarations, uploaded documents, and transaction instructions.
19. Privacy Policy — Purpose of Processing
Fiatano may collect, use, store, analyse, verify, and process Personal Data for the following purposes:
- To create, verify, and maintain user records.
- To conduct KYC, AML, CFT, sanctions screening, wallet screening, fraud checks, and enhanced due diligence.
- To process orders, payments, payouts, settlements, VDA transfers, refunds, cancellations, and reconciliations.
- To detect, prevent, investigate, and respond to fraud, scams, cybercrime, disputed payments, chargebacks, liens, and suspicious activity.
- To comply with legal, regulatory, tax, audit, accounting, law enforcement, court, and contractual obligations.
- To respond to user requests, complaints, support queries, transaction disputes, and legal notices.
- To secure Fiatano systems, prevent misuse, maintain logs, conduct internal audits, and improve service reliability.
- To enforce this document and protect Fiatano's rights, users, systems, funds, and legal interests.
20. Privacy Policy — Legal Basis and Consent
By using Fiatano, you consent to the collection, use, storage, processing, retention, transfer, and disclosure of your Personal Data as described in this document. Fiatano may also process Personal Data where necessary for contract performance, legal compliance, fraud prevention, risk management, legitimate business interest, dispute resolution, tax compliance, law enforcement cooperation, or protection of legal rights.
Where a separate consent is required by applicable law, Fiatano may request such consent through website forms, order forms, declarations, checkboxes, email, chat, or other communication channels.
21. Privacy Policy — Sharing and Disclosure
Fiatano may share Personal Data and transaction information where necessary for service delivery, compliance, security, fraud prevention, legal protection, tax reporting, dispute resolution, or law enforcement cooperation.
- Banks, payment gateways, payment aggregators, settlement providers, payout providers, and financial institutions.
- KYC vendors, AML screening providers, sanctions screening providers, wallet screening providers, blockchain analytics providers, and risk intelligence vendors.
- Technology service providers, hosting providers, cloud service providers, communication providers, email providers, analytics providers, and operational vendors.
- Auditors, accountants, tax consultants, legal advisors, compliance consultants, and professional advisors.
- Regulators, law enforcement agencies, cybercrime authorities, tax authorities, courts, tribunals, banks, and payment gateways where required or where Fiatano considers disclosure necessary to protect its rights or respond to suspected unlawful activity.
- Successors, assignees, affiliates, restructuring entities, or business transferees in connection with business transfer, merger, restructuring, or similar transaction.
22. Privacy Policy — Data Retention
Fiatano may retain Personal Data, KYC records, transaction records, tax records, communication records, payment records, wallet records, compliance records, audit logs, and dispute records for as long as required or permitted under applicable law, internal compliance requirements, tax requirements, accounting requirements, audit requirements, fraud prevention needs, dispute resolution, cybercrime investigation, or legal proceedings.
Even after a user stops using Fiatano, Fiatano may continue to retain necessary records where retention is required for legal, regulatory, evidentiary, audit, tax, fraud prevention, or legitimate business purposes.
23. Privacy Policy — Data Security
Fiatano uses reasonable technical, organisational, and administrative measures to protect Personal Data against unauthorised access, misuse, alteration, disclosure, loss, or destruction. However, no website, internet transmission, banking channel, blockchain network, communication channel, or storage system can be guaranteed as fully secure.
You are responsible for securing your own devices, email account, phone number, wallet, private keys, exchange accounts, passwords, OTPs, and authentication methods. Fiatano is not responsible for losses arising from user-side compromise, phishing, device malware, SIM swap, leaked credentials, private key exposure, or unauthorised access to user-controlled accounts.
24. Privacy Policy — Cookies and Technical Tracking
Fiatano may use cookies, pixels, logs, analytics tools, session tools, device identifiers, and similar technologies to operate the website, remember preferences, prevent fraud, analyse traffic, improve performance, secure sessions, and detect abuse. Users may control cookies through browser settings, but disabling cookies may affect website functionality.
25. Privacy Policy — User Rights and Requests
Subject to applicable law, you may request access, correction, update, or deletion of certain Personal Data. Fiatano may refuse or limit a request where retention or processing is necessary for legal compliance, tax records, AML obligations, fraud prevention, transaction evidence, dispute resolution, cybercrime response, security, or enforcement of legal rights.
Fiatano may require identity verification before processing any data request. Fiatano is not obligated to delete records that are required for compliance, legal defence, tax, audit, or fraud prevention purposes. You may also use in-app account deletion where available, subject to lawful retention exceptions.
26. Records and Evidence
You agree that Fiatano may maintain and rely upon KYC records, payment records, bank statements, gateway reports, transaction hashes, wallet addresses, chat records, call records where legally permitted, IP logs, device logs, email records, order history, screenshots, compliance notes, risk assessments, and internal records as evidence for transaction verification, dispute resolution, legal proceedings, tax compliance, cybercrime response, regulatory submission, and enforcement of this document.
27. Intellectual Property
All content, brand elements, website material, text, graphics, interface, workflows, software, documents, policies, service structure, trade name, and related intellectual property associated with Fiatano belong to Fiatano or its licensors. You must not copy, reproduce, modify, sell, exploit, scrape, reverse engineer, or misuse any Fiatano intellectual property without prior written permission.
28. Third-Party Services
Fiatano may use banks, payment gateways, payout providers, wallet providers, blockchain networks, liquidity providers, KYC vendors, AML vendors, hosting providers, communication providers, analytics providers, and other third-party service providers. Fiatano is not responsible for failures, delays, restrictions, errors, outages, downtime, losses, or acts of such third parties. Your use of third-party services may also be subject to their separate terms and policies.
29. Limitation of Liability
To the maximum extent permitted by law, Fiatano shall not be liable for market losses, VDA price movement, wrong wallet address, wrong network selection, blockchain delay, bank delay, payment gateway failure, chargeback, lien, cybercrime hold, regulatory action, user negligence, wallet compromise, loss of profits, business interruption, indirect loss, special loss, consequential loss, punitive damages, or incidental damages.
Fiatano's total liability, if any, shall not exceed the platform fee actually earned by Fiatano from the specific disputed transaction giving rise to the claim.
30. Indemnity
You agree to indemnify, defend, and hold harmless Fiatano and its owners, officers, directors, partners, employees, agents, affiliates, vendors, and representatives from any claim, loss, damage, liability, penalty, cost, expense, legal fee, proceeding, investigation, or demand arising from your breach of this document, false representation, unlawful activity, tax non-compliance, third-party payment, wrong wallet details, chargeback, cybercrime complaint, disputed payment, misuse of services, or violation of law.
31. Force Majeure
Fiatano shall not be liable for delay or failure caused by events beyond its reasonable control, including natural disaster, war, riot, government action, regulatory restriction, court order, law enforcement action, internet failure, power outage, banking outage, payment gateway outage, blockchain failure, cyberattack, exchange failure, liquidity crisis, or any other event beyond Fiatano's reasonable control.
32. Amendments
Fiatano may update, modify, replace, or revise this Terms and Conditions cum Privacy Policy at any time. Updated versions may be posted on the website with a revised effective date. Continued access to or use of Fiatano after an update constitutes acceptance of the updated document.
33. Severability and Assignment
If any provision of this document is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. You may not assign or transfer your rights or obligations under this document without Fiatano's written consent. Fiatano may assign, transfer, restructure, or delegate its rights and obligations to any successor, affiliate, acquiring entity, service provider, or business partner.
34. Governing Law
This Terms and Conditions cum Privacy Policy shall be governed by and interpreted in accordance with the laws of India.
35. Dispute Resolution and Jurisdiction
Any dispute, claim, or controversy arising out of or relating to Fiatano, this document, any transaction, payment, payout, VDA transfer, refund, chargeback, account restriction, data processing, privacy concern, user conduct, or related matter shall first be attempted to be resolved amicably.
If the dispute is not resolved amicably, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, Maharashtra. The language of arbitration shall be English. Subject to arbitration, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.
36. User Declaration
By using Fiatano, you confirm that you have read, understood, and accepted this Terms and Conditions cum Privacy Policy. You confirm that you are using your own lawful funds, that you will complete KYC and compliance checks, that you understand the risks of VDA transactions, that VDA transactions may be irreversible, that you are responsible for tax and legal compliance, and that you agree to indemnify Fiatano against losses caused by your conduct.
